Conduct: On 26 May 2020, Laok Mike Brando (“Mr Brando”) caused BLU Lounge Limited (“BLU Lounge”) to breach the terms and conditions of the Bounce Back Loan ("BBL") scheme by applying for a second BBL of £20,000, when he knew or ought to have known that BLU Lounge was only entitled to apply for one loan. In that: ? • Under the BBL scheme businesses were able to apply for a loan of up to 25% of their turnover to a maximum of £50,000. Businesses which originally borrowed less than the maximum amount available to them under the Scheme were eligible to top-up their original loan, however the total loan amount was not to exceed 25% of the business’ turnover or £50,000. Only one loan was available to businesses.?? • Mr Brando made an application with Bank A for a £20,000 BBL on behalf of BLU Lounge on 26 May 2020. On the same day, Mr Brando made a further application with Bank B for a £20,000 BBL on behalf of BLU Lounge.? • BBL funds from Bank A were paid into BLU Lounge’s bank account on 27 May 2020.??BBL Funds from Bank B were paid into BLU Lounge’s bank account on 29 May 2020 • Mr Brando signed the declaration on the application form for both BBL agreements on 26 May 2020 confirming that BLU Lounge was not in the process of applying for or had received any other BBL.? • BLU Lounge entered liquidation with liabilities totalling £42,109.77, of which £35,609.77 related to amounts owed in respect of the 2 BBLs.
