Conduct: On or around 4 August 2020, Mr Ivan Scobioala (“Mr Scobioala”) caused Ivan Construction Limited (“IC”) to make a Bounce Back Loan (“BBL”) application of £50,000 when he knew or ought to have known that IC was not entitled to a BBL of that amount. Mr Scobioala made a wrongful declaration on the BBL application using an overstated turnover figure. As a result, IC received more BBL funds than it was entitled to, in that: • Under the BBL scheme, businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of turnover. The turnover figure was self-certified by the applicant. The turnover figure required was that for the calendar year 2019, or where a business was established after 01 January 2019, an estimated turnover could be used • IC was incorporated on 23 July 2018 and commenced trading in July 2018. Mr Scobioala was appointed as a director on 23 July 2018 until IC entered liquidation on 26 March 2024. • On or around 4 August 2020, Mr Scobioala applied for a £50,000 BBL on behalf of IC, declaring turnover for the 2019 calendar year of £250,000. • The BBL of £50,000 was credited to IC’s bank account on 4 August 2020. • Financial Statements for the period 23 July 2018 to 31 July 2019 show turnover of £35,757 • Analysis of IC’s bank statements show that for the calendar year 2019, IC had credits totalling £55,157.66 • Based on the credits received in the 2019 calendar year IC was eligible for a BBL of no more than £13,789.41 and therefore received £36,210.59 more than it should have from the BBL scheme. • At liquidation £45,728.28 remained outstanding regarding the BBL
