Conduct: On 4 May 2020, Mr Ilya Kalinevich ("Mr Kalinevich") caused Coffeetrade Limited ("CL") to apply for a Government backed Bounce Back Loan with Bank 1 in the sum of £50,000 ("BBL1"). On 28 May 2020, Mr Kalinevich caused CL to apply for a second Government backed Bounce Back Loan from Bank 2 in the sum of £50,000 ("BBL2") for which it was not eligible by including false information within the application by not declaring that CL had previously applied for and obtained BBL1. Thereafter BBL2 in the sum of £50,000 was paid into CL's bank account on 29 May 2020. Further, BBL1 was not used in its entirety for the economic benefit of the business. In that: • As part of the application for a BBL, the applicant was required to self-declare that the application was the only application for a Bounce Back Loan made for the business. The BBL Scheme required the applicant to declare that the Bounce Back Loan funds would be used for the economic benefit of the business and not for personal benefit. • CL made an application to Bank 1 for BBL1 in the sum of £50,000 on 4 May 2020. • BBL1 was subsequently received into CL's Bank 1 bank account on 8 May 2020. • CL opened a bank account with Bank 2 on 27 May 2020. CL made an application to Bank 2 for BBL2 in the sum of £50,000 the following day, on 28 May 2020. • The BBL2 funds were received into CL's Bank 2 bank account on 29 May 2020. • CL received two Bounce Back Loans, contrary to the scheme rules, and received Bounce Back Loan funds in the total sum of £100,000 being £50,000 more than it was entitled. • The balance on CL's Bank 1 bank account prior to receipt of BBL1 was £12,842.14 overdrawn. • Following receipt of the BBL1 in the sum of £50,000 into Bank 1's bank account on 8 May 2020, the following payments were made from BBL1 funds which were either for the personal benefit of Mr Kalinevich, or which it has not been possible to confirm from CL's records were made for the economic benefit of CL: ? Payments to the net benefit of Mr Kalinevich totalling £2,746.57. ? Payments totalling £20,100 made between 13 May 2020 and 15 May 2020 to CL's money services provider account. • On liquidation, the overdrawn balance on CL's BBL1 bank account was £50,738.68 and BBL2 bank account was £50,633.45.
