Conduct: On 03 August 2020 Ms Alexandra Flavia Pojoni (‘Ms Pojoni’) applied for and obtained a Government-backed Bounce Back Loan (‘BBL’) of £50,000 for Handy Andy Car Cleaning Ltd (‘HACC’) by providing false or knowingly inaccurate information regarding HACC’s turnover in 2019, thereby causing it to obtain £25,967 in BBL funding to which it was not entitled. Ms Pojoni also failed to ensure that the proceeds of the loan were used in their entirety for the economic benefit of the business as required under the terms of the BBL scheme. Obtaining a BBL • The BBL scheme permitted a loan of up to 25% of a business’ turnover in the calendar year 2019 (or estimated annual turnover from the date it commenced trading if it had been established after 01 January 2019), from £2,000 to a maximum of £50,000; • HACC was incorporated in June 2018 and commenced trading at that time; • HACC’s bank statements record income of £96,133 in the calendar year 2019, which would have entitled it to a BBL of no more than £24,033; • On 03 August 2020 Ms Pojoni completed an application form for a BBL from HACC’s bank, self-certifying that its turnover in 2019 was £210,000 and requesting a loan of £50,000; • Ms Pojoni has stated that the turnover declared was based on expected revenue once the lease was renewed and investment made into the business to expand capacity. • As HACC was established before 01 January 2019 it was not entitled to estimate its turnover and the BBL application form makes that clear; • Therefore HACC obtained £25,967 in BBL funding to which it was not entitled; Disbursal of the BBL • The terms of the BBL scheme required the proceeds to be used solely for the economic benefit of the business; • Immediately before the receipt of the BBL the bank account balance was £346 cr.; • On 04 August 2020 the BBL was paid into HACC’s account; • Following this: o £12,431 was paid to the landlord in respect of another site, in which HACC had no interest; and o £27,720 was paid to Ms Pojoni. • Income in the period from the receipt of the BBL to 24 December 2020 was £14,113, therefore £25,692 of the above payments could not have been funded without the BBL; • There is no evidence that these payments were for the economic benefit of HACC’s business. • The bank submitted a claim in the liquidation for £37,023 and was the majority creditor.
