Conduct: Mehmet Emin Gulek (‘Mr Gulek’) provided inaccurate information in a Bounce Back Loan (“BBL”) application made on behalf of Montaguestexmexgsk Limited, by overstating Montaguestexmexgsk Limited turnover when he knew, or ought to have known, that Montaguestexmexgsk Ltd was not eligible for a BBL of that amount. As a result, Mr Gulek caused Montaguestexmexgsk Limited to receive BBL funds of £50,000 on 27 May 2020, which was £31,534 more than it was entitled to. In that: • Under the BBL scheme businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of turnover. The turnover figure was self-certified by the applicant. The turnover figure required was that for the calendar year 2019 or where a business was established after 1 January 2019 it was their estimated turnover.     • Montaguestexmexgsk Limited was incorporated on 13 June 2018 and began trading from 1 September 2018, it was therefore not allowed to estimate its turnover.   • Mr Gulek applied for a BBL of £50,000 on behalf of Montaguestexmexgsk Limited declaring that its turnover for the calendar year 2019 was £300,000. The application was dated 23 May 2020.   • Accounts for the year ending 30 June 2019 show the company turnover as £73,886 • Accounts for the year ending 30 June 2020 show the company turnover as £55,503 • Montaguestexmexgsk Limited was therefore entitled to obtain a BBL of no more than £18,471 if using the higher turnover amount from the 2019 accounts. • As a result of the BBL application £50,000 was paid in to an account held by the company on 27 May 2020. • The total liabilities at liquidation amount to £60,893 of which £29,752 relates to the amount owed in respect of the BBL.
