Conduct: On 17/05/2020, Mr Craig Shaw (Mr Shaw) provided inaccurate information to Barclays Bank UK PLC by overstating the turnover of Legacy Gas & Property Maitenance Limited (Legacy) in order to obtain a Government backed Bounce Back Loan (BBL) of £50,000, when he knew or ought to have known that Legacy was not entitled to a loan of that amount. Further, Mr Shaw failed to ensure the funds received were used for the economic benefit of Legacy’s business, which was in breach of the terms of the BBL. In that:- • The terms of the BBL scheme allowed a company to apply for a loan up to 25% of the annual turnover of the company in the calendar year 2019 from a minimum £2,000, up to a maximum of £50,000. If a business was established after 1 January 2019, the 25% limit could be applied to the estimated annual turnover from the date the business started. • On the BBL application dated 17/05/2020, Mr Shaw stated Legacy’s turnover was £200,000 and applied for a BBL of £50,000. Mr Shaw confirmed that the amount of BBL applied for was equal to or less than 25% of annual turnover for 2019, or of the estimated annual turnover. • On 19/05/2020, Legacy received the £50,000 BBL into its bank account. • On 10/07/2019, Legacy filed dormant accounts for the year ended 31/05/2019 at Companies House. • For the calendar year 2019, Legacy’s bank statements list trading credits into the account totalling £13,115.38. The company was entitled to apply for a BBL of £3,279 and therefore applied for and received £46,721 more than it was entitled to. • Between 19/05/2020 and 26/05/2020, Legacy made payments totalling £50,000 to Mr Shaw, which included a payment of £30,000 made on 22/05/2020. • Mr Shaw personally benefitted from the BBL. • The £50,000 BBL remained outstanding at the date of Liquidation.
