Conduct: On or around 05 June 2020, Justin Maynard (“Mr Maynard”) caused Food on Wheels Limited (“Food”) to breach the terms of the Bounce Back Loan scheme (“BBL”) by applying for a BBL of £15,000 when he knew or ought to have known Food was only entitled to apply for funds of £7,200. Mr Maynard applied funds totalling £15,000 for his personal benefit and not for the economic benefit of Food and failed to give notice to the bank of the dissolution of Food as required by Section 1006 Companies Act 2006. In that: • Under the BBL scheme businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of turnover. The turnover figure required was that for the calendar year 2019 or where a business was established after 1 January 2019 it is their estimated turnover. Businesses were required to use the loan only to provide economic benefit to the business, and not for personal purposes and confirm they have understood the costs associated with repayment of the loan and that they are able and intend to complete timely repayments in future • From 11 July 2019 (date of first receipt of income) and 04 March 2020, Food’s bank account shows an average monthly turnover of £2,400 giving an estimated annual turnover of £28,800 • On 05 June 2020 or around, Mr Maynard made an application for a BBL stating turnover to be £60,000 • On 08 June 2020, Food received a BBL of £15,000 • Between 08 June and 15 July 2020 Mr Maynard received net payments totalling £15,000 • On 24 July 2020, Mr Maynard applied to dissolve Food • As of 24 July 2020, the full amount of the BBL remained outstanding • Food failed to give notice to the bank of its application for dissolution • On 26 October 2020 Food was dissolved and the BBL of £15,000 remains outstanding
