Conduct: Poncho Sales and Marketing Ltd Nuno Miguel Teixeria Alves (“Mr Alves”) caused Poncho Sales & Marketing Ltd (“Poncho”) to breach the terms and conditions of the Bounce Back Loan (‘BBL’) scheme by failing to use the funds obtained from the BBL scheme for the economic benefit of Poncho, in that: • The terms of the BBL scheme required the proceeds of any loan obtained to be used solely for the economic benefit of the business. • On 07 May 2020, Mr Alves applied for a £50,000 BBL, and Poncho received the loan funds in its bank account on 07 May 2020. Prior to this receipt, the balance of the account was £527. • Between 11 May 2020 and 15 June 2020, payments totalling £24,100 was transferred out of the account, Mr Alves stated that this money was transferred to a connected third party for investment purposes, however no evidence has been provided to show that this was for the benefit of Poncho, • Furthermore on 16 June 2020, £13,000 was transferred to a personal account of Mr Alves. No evidence has been provided to show that this was for the benefit of Poncho, • Between 11 May 2020 & 16 June 2020, Poncho received no trading income. • Poncho was placed into Creditors Voluntary Liquidation on 29 September 2022. • Total liabilities at liquidation amount to £62,722.88 of which £50,000.00 relates to the amount owed in respect of the BBL. Pivot Car Rentals Ltd Mr Alves caused Pivot Car Rentals Ltd (“Pivot”) to obtain a government backed Bounce Back Loan (“BBL”) of £50,000, when the company was not eligible for the loan. Furthermore, no evidence has been provided to show that the BBL proceeds were utilised in their entirety for Pivot’s economic benefit, in that: • The BBL criteria stated that borrowers were required to declare that the business was carrying on its business on 1 March 2020 and had been adversely impacted by COVID-19. • Pivot was incorporated on 27 February 2019 • Pivot’s bank statements revealed the account was opened on 23 September 2020 and was not in receipt of any trading income. • On 28 September 2020, Mr Alves caused Pivot to obtain a BBL of £50,000, an annual turnover of £225,000 was stated on the application form. The BBL of £50,000 was transferred to the company bank account on 29 September 2020. • Between 02 October 2020 and 06 October 2020, £50,000 was transferred to a personal account of Mr Alves. No evidence has been provided to show that this was for the benefit of Pivot, contrary to the terms and conditions of the scheme. • On 07 December 2021, Pivot was dissolved at which time the BBL of £50,000 remained outstanding. Ratdog Garage Ltd Mr Alves caused Ratdog Garage Ltd (“Ratdog”) to obtain a government backed Bounce Back Loan (“BBL”) of £50,000, when the company was not eligible for the loan. Furthermore, no evidence has been provided to show that the BBL proceeds were utilised in their entirety for Ratdog’s economic benefit, in that: • The BBL criteria stated that borrowers were required to declare that the business was carrying on its business on 1 March 2020 and had been adversely impacted by COVID-19. • Ratdog was incorporated on 4 February 2020 • Ratdog’s bank statements revealed the account was opened on 07 October 2020 and was not in receipt of any trading income. • On 07 October 2020, Mr Alves caused Ratdog to obtain a BBL of £50,000. • Between 08 October 2020 and 12 October 2020, £50,000 was transferred to Mr Alves’s personal bank account. No evidence has been provided to show that this was for the benefit of Ratdog, contrary to the terms and conditions of the scheme. • Ratdog was placed into Creditors Voluntary Liquidation on 8 July 2024 with liabilities totalling £47,522 of which £46,847 related to the BBL
