Conduct: On 19 May 2020, Marcin Piotr Losek (“Mr Losek) caused MPLT Limited to breach the terms and conditions of the Bounce Back Loan (“BBL”) scheme by overstating its turnover on the BBL application, as a result MPLT Limited received more funds than it was entitled to from the BBL scheme. In that: • Under the BBL scheme businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of turnover. The turnover figure was self-certified by the applicant. The turnover figure required was that for the calendar year 2019, or where a business was established after 01 January 2019 it is their estimated turnover. • MPLT Limited was incorporated on 4 April 2018. • On 16 May 2020, Mr Losek applied for a BBL of £47,000 on behalf of MPLT Limited declaring that its turnover for the calendar year 2019, or estimated annual turnover was £188,000. • Accounts for MPLT Limited for the period ending 30 April 2019, signed on 30 July 2019 by Mr Losek, record turnover for the trading period to be £25,639. • MPLT Limited’s bank account records turnover for the period 01 May 2019 to 31 December 2019 to be £28,450. • By making an application to borrow £47,000, MPLT Limited received a BBL of at least £33,477 more than it was entitled to. • On 19 May 2020 MPLT Limited received the BBL funds of £47,000 into its bank account. • MPLT Limited made repayments of £5,054 towards the BBL. • MPLT Limited entered into Creditors Voluntary liquidation on 18 October 2022. Total liabilities at liquidation amounted to £46,479.03 of which £43,479,000 was the amount owed in respect of the BBL.
