Conduct: Mr Jafirbhai Ismail Patel (“Mr Patel”) caused or allowed SDG General Trading Ltd (“SDG”) to breach the terms of the Bounce Back Loan Scheme by overstating its turnover on an application for a Bounce Back Loan (“BBL”) resulting in the company receiving a BBL of £50,000 when he knew or ought to have known that SDG was not eligible for a loan of this amount, in that:  • The BBL scheme rules allowed businesses to receive a loan of up to 25% of their annual turnover for the 2019 calendar year, which those businesses would self-certify when completing the BBL application. It was a condition of the BBL scheme that funds were to be used for the economic benefit of the business. • The company’s Annual Accounts for financial year ending 31 March 2019 and 31 March 2020 show SDG achieved a turnover of £19,804 and £13,189 respectively.   • Bank statements show that between 01 January 2019 and 31 December 2019, the company received income of £33,287. • SDG declared on the company’s BBL application form on 12 June 2020 an annual turnover of £225,000 and applied for a BBL of £50,000. This was paid into the bank account on 12 June 2020. • Based on the income into the bank account for the 2019 calendar year, the company was entitled to a maximum BBL of £8,321.75 and therefore received at least £41,678.25 more in BBL funding than it was entitled to. • At liquidation, liabilities totalled £166,757 of which £30,275 was owed to the Bank in respect of the BBL.
