Conduct: On 22 May 2020 Rafal Kolodzinski (“Mr Kolodzinski”) caused Collie Build and Design Ltd (Collie) to apply for a Bounce Back Loan (“BBL”) of £50,000 using overstated turnover figures, which resulted in Collie obtaining a BBL that was £43,608 more than it was entitled to. In that: • Under the BBL scheme businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of turnover. The turnover figure was self-certified by the applicant. The turnover figure required was that for the calendar year 2019 or where a business was established after 1 January 2019 it is their estimated turnover. • Collie was incorporated on 06 March 2018. The bank account for Collie was opened on or around 18 July 2018, and the first obvious trading income into this account was received 17 December 2018. • On 22 May 2020, Mr Kolodzinski applied for a BBL of £50,000 on behalf of Collie declaring that its turnover for the calendar year 2019 was £225,000. • Collie received the BBL funds of £50,000 22 May 2020. • The year end financial accounts for Collie show the following turnover values: o 31 March 2019 £1,052 o 31 March 2020 £42,332 • Analysis of the bank statements for Collie’s account show company turnover for the period 01 January to 31 December 2019 to be approximately £25,567. • The business was therefore not eligible to receive more than £6,392 based on the terms of the BBL application. • Collie received £43,608 worth of BBL to which it had no entitlement. • Total liabilities at liquidation amount to £57,301 of which £35,732 relates to the amount owed in respect of the BBL.
