Conduct: On 09 May 2020 David John Smith (“Mr Smith”) breached the terms of the Bounce Back Loan Scheme by causing Lasersure Limited (“LL”) to overstate its turnover on its application for a Bounce Back Loan (“BBL”) resulting in LL receiving a BBL of £50,000 when he knew or ought to have known that LL was only eligible for a loan to a maximum of £12,637. In that: • Under the BBL scheme businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of turnover. The turnover figure was self-certified by the applicant. The turnover figure required was that for the calendar year 2019 or where a business was established after 01 January 2019 it was their estimated annual turnover from the date the business started. • LL was incorporated on 22 February 2018 and started to trade on or around 03 April 2018. • LL’s accounting records show for the year ended 28 February 2019 LL’s turnover was £7,766 and for the year ended 29 February 2020 LL’s turnover was £50,032. • On 09 May 2020 Mr Smith applied for a BBL of £50,000 on behalf of LL declaring that LL’s annual turnover for the calendar year 2019 was £805,000, and consequently on 09 May 2020 LL received £50,000. • Company bank statements evidence receipts of £50,550 for the calendar year 2019. Meaning that LL would have been entitled to a BBL of no more than £12,637. LL received at least £37,362 more than it was entitled to from the BBL scheme. • Total liabilities at liquidation were £165,164 including £46,495 owed to the bank in respect of the BBL obtained.
