Conduct: On 5 May 2020 Gursharen Singh Sooch (“Mr Sooch”) caused Kingsley Specials Limited (“KSL”) to apply for a Bounce Back Loan (“BBL”) of £49,999 and did not use the proceeds for the economic benefit of KSL. On 16 May 2020 Mr Sooch caused KSL to make a fraudulent application for a second BBL of £49,999 to which KSL was not entitled having already received a BBL. In that. Under the BBL scheme businesses were able to apply for up to 25% of their turnover to a maximum of £50,000. Funds from the BBL were to be used for the economic benefit of the company. Only one BBL per business was permissible. Mr Sooch made an application for a BBL of £49,999 with Bank A on behalf of KSL on 5 May 2020. The BBL funds were paid into KSL’s bank account on 7 May 2020. KSL’s accounting records show that the entirety of the BBL was credited to Mr Sooch’s Directors loan account. Mr Sooch made a further BBL application of £49,999 with Bank B on behalf of KSL on 16 May 2020. Mr Sooch signed the declaration on the application form and BBL agreement on 16 May 2020 confirming that KSL had not already obtained a BBL or was in the process of applying for a BBL. The funds from KSL’s second BBL were paid into its bank account on 18 May 2020. KSL’s accounting records show that the entirety of the second BBL was credited to Mr Sooch’s Directors loan account. Total liabilities at liquidation amount to £452,003, £99,998 which relates to amounts owed in respect of the 2 BBLs.
