Conduct: Ms Rathy Kumaraguru (Ms Kumaraguru) caused Rathy Ltd (Rathy) to apply for a Government backed Bounce Back Loan (“BBL”) of £30,000 that it was not eligible for, having obtained a previous BBL for £18,000 on 22 May 2020 from a different lender, in that: On 22 May 2020, Ms Kumaraguru applied for a BBL of £18,000 from Bank A on behalf of Rathy. This application was completed within the terms and conditions of the BBL scheme and Rathy received £18,000. The terms of the BBL Scheme state that borrowers are required to declare that they are not in the process of applying for or have not already received a BBL Scheme facility. On 08 October 2020, Ms Kumaraguru applied for a second BBL of £30,000 from Bank B. This application was not within the terms and conditions of the BBL scheme as Rathy had already received one BBL previously. On 17 November 2022 Rathy entered Creditors Voluntary Liquidation At liquidation, Rathy had liabilities of £ 52,324.47 including £48,750 owing in respect of the two BBL’s
