Conduct: Alexandru Simboteanu (“Mr Simboteanu”) caused Nitrosimus Ltd (“NL”) to apply for a Bounce Back Loan (“BBL”) of £49,500 using overstated turnover figures. As a result NL obtained a BBL when Mr Simboteanu knew, or ought to have known, that NL was not eligible for a loan of that amount as it was £47,368 more than NL was entitled to. In that: • Under the BBL scheme businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of turnover. The turnover figure was self-certified by the applicant. The turnover figure required was that for the calendar year 2019 or where a business was established after 1 January 2019 it is their estimated turnover. • NL was incorporated on 24 November 2017. • Mr Simboteanu applied for a BBL of £49,500 on behalf of NL declaring that its turnover for the calendar year 2019 was £210,000. • Accounts for the period 01 December 2018 to 30 November 2019 (signed by Mr Simboteanu on 5 August 2020) show turnover of £4,471. • Bank Statements from 1 January 2019 to 31 December 2019 show income of £8,526, which has been used as the turnover figure to calculate the overstatement. • NL received the BBL funds of £49,500 on 22 September 2020. • Total liabilities at Liquidation amount to £39,386 of which £38,386 relates to the amount owed in respect of the BBL.
