Conduct: On 06 June 2020, Reema Yasmin Miah ("Ms Miah") caused Reema Express Limited ("REL") to apply for a Government backed Bounce Back Loan ("BBL") from HSBC Bank Plc ("HSBC") in the sum of £50,000 to which it was not entitled to by including inaccurate information relating turnover. Thereafter, the BBL was paid into REL's bank account on 09 June 2020 and was not used in its entirety for the economic benefit of the business. In that: Misuse of BBL Scheme • REL was incorporated on 21 November 2017. • Where a business was established before 1 January 2019, it was entitled to apply for a BBL of between £2,000 and £50,000 up to a maximum of 25% of turnover for the calendar year ended 31 December 2019. • On 6 June 2020, Ms Miah applied for a BBL of £50,000 on behalf of REL. • Annual turnover for 2019 in the sum of £250,000 was declared in the BBL application. • REL's bank account statements record receipts into the bank account during the calendar year 2019 totalling £58,279.38. • Based on a turnover of £58,279.38, the maximum BBL which REL was entitled to receive was in the sum of £14,569.85, and not the sum of £50,000 it received. • REL therefore received £35,430 more in BBL funds than it was entitled to receive. Use of funds • The BBL scheme required the applicant to declare that BBL funds would be used in their entirety for the economic benefit of the business, and not for personal use. • Prior to receipt of the BBL in the sum of £50,000 on 09 June 2020, the balance on REL's bank account was £2,083.43. • Following receipt of the BBL, Ms Miah received payments totalling £71,009.65 reference "Miss R Y Miah Cash" between 28 June 2020 and 12 October 2021. • Total receipts into REL's bank account between receipt of the BBL funds on 09 June 2020 and 12 October 2021 totalled £30,077.58. • Miss Miah personally benefited from BBL funds in the sum of £38,848.64. • The Statement of Affairs signed by Miss Miah on 24 March 2023 records a balance of £50,000 owed to HSBC in the liquidation in respect of the outstanding BBL. • The Bank statements record that the outstanding balance on the BBL account on liquidation was £50,421.64.
