Conduct: Ms Johanna Elizabeth Anne Adair (“Ms Adair”) breached the terms of the Bounce Back Loan (“BBL”) scheme by causing The British Georgian Basalt Co Limited (“TBGBCL”) to overstate its turnover on its application for a BBL, resulting in the company receiving a BBL of £39,600 when she knew, or ought to have known, that TBGBCL was not eligible for a loan of that value, in that: • The BBL scheme terms allowed businesses to receive a loan of up to 25% of their annual turnover for the 2019 calendar year, which the applicant would self-certify when completing the BBL application.   • If a company was established after 01 January 2019, they were allowed to estimate the company turnover from the date the company started to trade. • TBGBCL was incorporated on 13 November 2017 and began trading straight away. • Ms Adair declared on the company’s BBL application form an annual turnover of £197,370, and consequently on 24 June 2020 TBGBCL received a £39,600 BBL. • Annual accounts for financial year ending 30 November 2019 show the company declared a turnover of £0. • Annual accounts for financial year ending 30 November 2020 show the company declared a turnover of £3,033. • This would have meant that TBGBCL would not have been entitled to apply for a BBL as the company did not meet the minimum turnover required. • The overstatement of turnover meant that TBGBCL received £39,600 more than it was entitled to from the BBL scheme. • TBGBCL entered Creditor’s Voluntary Liquidation on 05 January 2023. • At liquidation, TBGBCL had liabilities totalling £139,943, of which £39,942.13 was owed to the bank in respect of the BBL.
