Conduct: Mohammed Azhar Miah (‘Mr Miah’) caused or allowed Direct Motors London Limited (‘Direct Motors’) to apply for a government backed Bounce Back Loan (‘BBL’) of £50,000 that it was not eligible for, in that: As per the BBL scheme, to be eligible for a BBL, businesses must have been engaged in trading or commercial activity in the UK at the date of the application and was carrying on business on 1 March 2020. Dormant accounts were filed for Director Motors for the financial year ending 31 October 2020. Mr Miah has stated that the dormant accounts were filed in error and that the company was trading. No documentation has been provided to support this explanation. The annual turnover stated on the company’s BBL application form was £367,516. Consequently, on 19 August 2020 the company received £50,000 BBL funds. Based on the filed dormant accounts to 31 October 2020, it does not appear that Direct Motors was actively trading at 1 March 2020 and at the date of the application, therefore the company received a £50,000 BBL that it was not eligible for. At liquidation, Direct Motors owed £50,100, of which at least £50,000 was owed in respect of the BBL.
