Conduct: In October 2020 Christopher Brian Britton (“Mr Britton”) caused JRE Projects Limited (“JRE”) to apply for and obtain a Government backed bounce back loan “(BBL”) in the sum of £37,500 and failed to use at least £36,648 of the BBL for the economic benefit of the business, in breach of the terms of the scheme, in that: On 30 October 2020 JRE received £37,500 into the company bank account from a bounce back loan. The terms of the BBL stated that its intended purpose was to provide economic benefit for the business and not for personal purposes. On 30 October 2020 £20,000 was transferred to Mr Britton’s personal bank account. A further £8,360 was transferred to Mr Britton’s personal bank account on 01 December 2020 No records have been delivered up to the Liquidator to show that these funds were used for the benefit of JRE Between 02 November 2020 and 30 November 2020 other payments totalling £8,288 were paid out of JRE’s bank account. No records have been delivered up to the Liquidator to show that these funds were used for the benefit of JRE. Between April 2020 and October 2020, Mr Britton caused JRE Projects Ltd to incorrectly claim 7 payments for himself from the government’s coronavirus job retention scheme (“CJRS”) In that; Eligibility for payments under the CJRS required that a person was enrolled as an employee on the company’s PAYE scheme as at 19 March 2020 HM Revenue and Customs (“HMRC”) had been notified on 30 December 2019 that Mr Britton was no longer an employee of JRE 7 CJRS payments totalling £10,750 were made directly to Mr Britton, by HMRC, between 06 April 2020 and 31 October 2020 Mr Britton was not enrolled as an employee of JRE on 19 March 2020, so was not entitled to any of the 7 payments made.
