Conduct: On 14 May 2020, Aman Mahroof (“Mr Mahroof”) caused Jelly Days to make a false application for a bounce back loan (“BBL”) and, contrary to the scheme’s published guidance, failed to ensure that the funds were used for the economic benefit of the business, in that: • Under the BBL scheme businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of turnover. The turnover figure was self-certified by the applicant. Where a business was established prior to 1 January 2020 the turnover figure required was that for the 2019 calendar year. • Borrowers were required to declare, amongst other things, that the business was carrying on its business on 1 March 2020 and was engaged in trading or commercial activity in the UK at the date of the application. • Jelly Days was incorporated on 04 October 2017, however did not generate any turnover during the 2019 calendar year, and submitted dormant accounts for the accounting periods ending 31 October 2019 and 31 October 2020. Jelly Days was ineligible to apply for a BBL based on the turnover, carrying on its business on 1 March 2020, and trading at the date of the application criteria. • On 14 May 2020, Mr Aman Maroof, made the BBL application on behalf of Jelly Days, declaring Jelly Days’ annual turnover to be £175,000. The declared turnover was an estimate. • Aman Maroof was not an appointed director of Jelly Days but both he and his co-director have stated he should have been appointed as such. • The amount of loan obtained was £43,000 and this was transferred to Jelly Days’ account ending 2189 on 22 May 2020. • For the accounting period to 31 October 2021 Jelly Days filed a further set of dormant accounts and no evidence has been provided that at least £42,181 of the BBL funds were used for the economic benefit of Jelly Days. • When Jelly Days went into liquidation on 27 April 2023, there was an outstanding balance of £33,519 in respect of the BBL.
