In that: • The terms & conditions (‘T&Cs’) of the BBL scheme required BBL applicants to state their annual turnover for the 2019 calendar year or, if the applicant company was established after 1 January 2019, an estimated annual turnover commencing from the date the applicant business started; • The T&Cs stated that an applicant could request a BBL of 25% of the stated turnover subject to being an amount in between £2,000 and £50,000; • A business was eligible to apply for the loan if it was established on or before 1 March 2020, was engaged in trading or commercial activity in the UK at the date of the application, was carrying on business on the 1 March 2020 and had been adversely effected by coronavirus; • BG Construct was incorporated on 4 October 2017; • Dormant accounts were filed for the period 4 October 2017 to 31 October 2018 and the year ended 31 October 2019 whilst those for the year ending 31 October 2020 list BG Construct’s turnover at £9,463; • On 12 June 2020, Mr Demiri signed a BBL application form on behalf of BG Construct with the company’s bankers quoting an annual turnover of £197,000 and received a BBL offer of £45,900; • On 15 June 2020, BBL funds of £45,900 were paid into BG Construct’s bank account; • The company’s bank account into which the BBL was received was opened on 13 June 2020; • No evidence has been provided to show that BG Construct was carrying on its business as at 1 March 2020 and was engaged in trading or commercial activity in the UK at the date of the BBL application being 12 June 2020; • At the date of the Liquidation on 31 January 2023, a total of £46,744.43 was owed in respect of the BBL.
