Conduct: Tina Farrell (“Mrs Farrell”) caused or allowed Goldthorn Associates Ltd (“Goldthorn”) to apply for a Bounce Back Loan (“BBL”) of £48,000, when she knew or ought to have known that the company was not eligible for a BBL. In that: - • Under the BBL scheme businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of turnover. The turnover figure was self-certified by the applicant. The turnover figure required was that for the calendar year 2019 or where a business was established after 01 January 2019 it was their estimated annual turnover from the date the business started; • Goldthorn was incorporated and started to trade on 26 September 2017; • Goldthorn’s accounts for the year ended 30 September 2019, approved by a co-director on 29 October 2019, disclose a turnover of nil; • Goldthorn’s accounts for the period 01 October 2019 to 31 March 2021, approved by a co-director on 12 December 2021, disclose a turnover of nil; • Between 1 January 2019 and 31 December 2019, income into the company’s bank account totalled £30, all of which was provided by a co-director; • On 18 August 2020 a co-director applied for a BBL of £48,000 on behalf of Goldthorn, declaring that its annual turnover was £192,000. Goldthorn received BBL funds in the sum of £48,000 on 21 August 2020; • Based on receipts into Goldthorn’s bank account for the year ended 31 December 2019, which Mrs Farrell should have been aware of, and the Accounts for the Year Ended 30 September 2019, the company was not entitled to a BBL. Goldthorn therefore received £48,000 more than it was entitled to from the BBL scheme; • Total liabilities at Liquidation were £79,101, including £48,326 owed to the bank in respect of the BBL obtained.
