Conduct: Azizul Miah (“Mr Miah”) caused Saffron Indian Takeaway (Paddock Wood) Ltd (“Saffron”) to apply for a Bounce Back Loan (“BBL”) of £50,000, received by Saffron on 22 May 2020, by overstating the company’s turnover. As a result, Saffron received more funds than it was entitled to from the BBL scheme. Furthermore, BBL funds obtained were transferred to Mr Miah personally rather than being used for the economic benefit of Saffron, as was required by the terms of the BBL scheme: • Under the BBL scheme businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of turnover. The turnover figure was self-certified by the applicant. The turnover figure required was that for the calendar year 2019 or where a business was established after 01 January 2019 it was their estimated annual turnover from the date the business started; • Saffron was incorporated on 22 September 2017. Saffron’s accounts for periods ended 31 March 2019 and 31 March 2020 show turnovers of £80,260 and £84,061 respectively; • Saffron’s bank statements show receipts of £62,497 for calendar year 2019; • Saffron received a BBL of £50,000 on 22 May 2020, the BBL application submitted having declared that its annual turnover was £200,000; • Following receipt of the BBL, on 28 May 2020 the full amount of the £50,000 BBL funds received was paid to Mr Miah personally. Mr Miah has failed to evidence that the BBL funds were received for the economic benefit of the company; • Total liabilities at liquidation were £45,437, including £33,333 owed to the bank in respect of the BBL obtained.
