Conduct: On 08 July 2020, Mrs Victoria Lee Monteith (“Mrs Monteith”), caused or allowed Platinum Music & Events Limited (“PME”) to make a Bounce Back Loan (“BBL”) application of £30,000 when she knew or ought to have known that PME was not eligible for the BBL, as PME was not engaged in trading or commercial activity as at 01 March 2020 nor at the date of the BBL application. Furthermore, Mrs Monteith caused or allowed PME to expend £28,669 of the BBL funds for purposes that did not provide economic benefit to PME contrary to the terms and conditions of the BBL scheme. In that: • Under the BBL scheme businesses met the eligibility criteria if they were engaged in trading or commercial activity in the UK at the date of the application and were carrying on business as at 01 March 2020. • PME’s most recently appointed accountant states that PME commenced and ceased to trade within the period 01 September 2017 to 30 September 2018 and did not trade during the period of his appointment being October 2020 to November 2021. • Full unaudited financial statements for the periods ending 30 September 2019 and 30 September 2020, provided by PME’s most recently appointed accountant, indicate that PME did not generate any turnover in either of those accounting periods. • On 08 July 2020, an application was made for a BBL of £30,000 on behalf of PME. The BBL application form stated PME’s turnover for the calendar year 2019 to be £120,000.  • PME received the BBL funds of £30,000 on 14 July 2020, into the only known bank account operated by PME, and this was the first transaction on the bank account. • Between 15 July 2020 and 22 August 2020, payments of £28,669 were made to personal credit cards held by a co-director and to a personal bank account in the account held jointly by Mrs Monteith and the same co-director. These transactions did not provide economic benefit to PME. • On 29 September 2022, PME entered Creditor’s Voluntary Liquidation with total liabilities of £29,017, of which £28,667 was owed in respect of the BBL.

The BBL application form detailed Mr Monteith as the applicant and stated PME’s turnover to be £120,000.  • PME received the BBL funds of £30,000 on 14 July 2020, into the only known bank account operated by PME, and this was the first transaction on the bank account. • Between 15 July 2020 and 22 August 2020, payments of £28,669 were made to Mr Monteith’s personal credit cards and a personal bank account held jointly in the name of Mr Monteith and his co-director.
