Conduct: On 04 May 2020, Mohammed Irfan (“Mr Irfan”) caused Konsolzvapez Limited (“KVL”) to breach the Terms and Conditions of the Bounce Back Loan (“BBL”) Scheme by making a declaration that he knew or ought to have known was incorrect regarding KVL’s turnover in order to obtain a £50,000 BBL. As a result, KVL has received £42,868 more than it was entitled to, in that: Under the BBL scheme, businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of turnover. The turnover figure was self-certified by the applicant. The turnover figure required was that for the calendar year 2019 or where a business was established after 01 January 2019, an estimated turnover could be used. ?? KVL was incorporated on 25 August 2017 and started trading before 30 September 2018. On 04 May 2020, Mr Irfan submitted an application to obtain a BBL of £50,000 on behalf of KVL, declaring that its turnover for the calendar year 2019 was £220,000. The BBL funds were credited into KVL’s bank account on 05 May 2020. Accounts for the year ending 30 September 2019 show that KVL had a turnover of £24,775. Analysis of KVL’s bank account shows that between 01 January 2019 and 31 December 2019, KVL received income of £28,526. Based on the income received into its bank account in the calendar year of 2019, KVL was entitled to apply for a BBL of no more than £7,132. KVL entered liquidation with liabilities totalling £70,257.49 of which £51,203.09 relates to the amount owed in respect of the BBL.
