Conduct: On 06 May 2020 Taha Yeasin (“Mr Yeasin”) provided false information regarding the turnover of New bright Horizon Ltd (“New Bright”) in order to obtain a BBL of £42,000 when he knew or ought to have known New Bright was not entitled to the full amount. In that: • New Bright was incorporated on 17 July 2017 • Mr Yeasin was appointed as the sole director from incorporation until Liquidation. • Under the BBL scheme rules, a company that was carrying on business on 01 March 2020 was eligible for one BBL of 25% of its 2019 calendar year turnover, up to a maximum of £50,000. When making an application for a BBL, an applicant had to self-certify the company’s 2019 calendar year turnover. Where a company commenced trading after 01 January 2019, the applicant was entitled to provide a reasonable estimate of Company annual turnover from the date it started business. • Also, under the BBL scheme rules, the BBL funds were to be used entirely for the economic benefit of the Company. • On 06 May 2020, Mr Yeasin applied to the bank for a BBL in the sum of £42,000 having declared that New Bright’s turnover was £170,000. • Dormant accounts were filed for the year ending 31 July 2019. Based on this, New Bright were eligible to predict the turnover, for the first year of trade, providing trading had commenced by 01 March 2020. • Accounts for the 12 months ending 31 July 2020, record turnover of £41,499. Based on this, New Bright was entitled to a maximum BBL of £10,375 • By applying for a BBL of £42,000 New Bright received £31,625 more than it was entitled to. • The BBL proceeds of £42,000 were received on 11 May 2020. • On 06 June 2020, the sum of £12,000 was transferred to a credit card company in Mr Yeasin’s personal name in relation to a debt outstanding from May 2018 at the latest. • Between 09 and 22 July 2020, the sum of £25,742 was transferred to parties unknown. • At liquidation the sum of £32,624 remained outstanding in respect of the BBL to Barclays.
