Conduct: Nathan McDonnell (“Mr McDonnell”) caused Skyile Consulting Limited (“SCL”) to apply for and obtain a government backed Bounce Back Loan (“BBL”) of £49,000 when SCL was not eligible and failed to use the BBL for the economic benefit of the company, which was contrary to the terms of the BBL agreement, in that: • The BBL scheme required that the applicant be trading at 01 March 2020 and permitted a loan of up to 25% of a business’ turnover in the calendar year 2019 or estimated turnover if it had been established after 01 January 2019. • SCL filed Dormant accounts for the years ending 30 June 2018 and 2019. Micro-entity accounts were filed for the year ended 30 June 2020 showing the Company had a balance of £1 on the Balance Sheet. • On 10 November 2020, Mr McDonnell applied for a BBL, declaring that that SCL’s estimated turnover was £198,000. No evidence has been provided to support this estimate. • Bank statements do not evidence any trading by SCL either at 01 March 2020 or at the time of the application. There were no transactions in SCL’s bank account prior to receipt of the BBL funds which were received on 10 November 2020. • The sum of £37,462.35 was paid to a third party between 17 November 2020 and 24 November 2020. Invoices relating to these third party payments have been provided, however the third party named on the invoices confirmed that they had no contact with SCL. • The sum of £9,099 was paid direct to the director between 14 November 2020 and 14 March 2021. • No other accounting records have been supplied by the Director to explain the company’s trade or to evidence that the BBL was used for the economic benefit of the company. • The BBL remains outstanding at the date of liquidation and the bank has made a claim of £49,325.
