Conduct: On 21 May 2020, Robertino-Iulian Alecu (“Mr Alecu”) provided false or knowingly inaccurate information concerning Group4 Logistics Ltd’s (“Group4”) turnover in it’s application for a Government-back Bounce Back Loan (“BBL”) scheme resulting in Group4 obtaining an additional £41,132.25 BBL funding to which it was not entitled. Furthermore, the BBL funds were not used in their entirety for the economic benefit of Group4, in that: • A company that was trading at 01 March 2020 was eligible for a BBL of 25% of its actual turnover in the calendar year 2019 or, if it commenced trading after 01 January 2019, 25% of its estimated annual turnover from the date the business was started. Any BBL provided was to be used wholly for the economic benefit of the applicant • company; • Group4 was incorporated on 05 May 2017 and commenced trading on or around that date as a freight transporter and was eligible for a BBL of 25% of its actual turnover in the calendar year 2019; • On 28 February 2020, Mr Alecu approved Group4’s accounts for the year ended 31 May 2019 which showed turnover of £35,471; • Group4 bank statements from 01 June 2019 to 31 May 2020 show income totalling £25,694. • On 21 May 2020, Mr Alecu made an application on behalf of Group 4 to its bank for a BBL of £50,000 declaring Group4’s turnover to be £200,000; • Group4 received the BBL of £50,000 into its bank account on 26 May 2020 which was £41,132.25 more than it was entitled to based on actual turnover for the year ended 31 May 2019; • Group4’s bank account was overdrawn by £4,996 just prior to receipt of the BBL funds. • Between 26 May 2020 and 03 August 2022, date of liquidation, payments of £35,881 were made to or for the benefit of Mr Alecu, during which Group4 received no trading income. • No evidence has been provided by Mr Alecu to show that these payments were for the economic benefit of Group4, • Group4 entered creditor’ voluntary liquidation on 03 August 2022 with total liabilities of £58,571 comprising £51,042.57 in respect of the BBL.
