Conduct: Mark Kenneth Brown (“Mr Brown”) caused MKB Access Solutions Ltd (“MKB”) to apply for a Bounce Back Loan (“BBL”) of £50,000, received by the company on 21 July 2020, when he knew or ought to have known that the company turnover he included in the BBL application was overstated. As a result, MKB received more than it was entitled to from the BBL scheme. In that: • Under the BBL scheme businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of turnover. The turnover figure was self-certified by the applicant. The turnover figure required was that for the calendar year 2019 or where a business was established after 01 January 2019 it was their estimated annual turnover from the date the business started; • MKB was incorporated on 24 April 2017 and started to trade in 2017. MKB’s accounts disclose turnovers for the years ended 30 April 2019 and 30 April 2020 of £57,724 and £46,098 respectively. Based on the turnover to April 2019 MKB was entitled to a BBL of no more than £14,431; • Mr Brown applied for a BBL of £50,000 on behalf of MKB declaring that its annual turnover was £200,000. MKB received the BBL funds of £50,000 on 21 July 2020; • Total liabilities at Liquidation were £56,675, including £47,339 owed to the bank in respect of the BBL obtained.
