Conduct: On 6 July 2020, Mr Imam Yildiz (“Mr Yildiz”), caused Kaye Foods Ltd (“Kaye”) to apply for a Bounce Back Loan (“BBL”) of £50,000 using overstated turnover figures, which resulted in Kaye obtaining at least £28,386 more in BBL funds than it was entitled to, in that: • Under the BBL scheme businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of turnover. The turnover figure was self-certified by the applicant. The turnover figure required was that for the calendar year 2019 or, where a business was established after 1 January 2019, it is their estimated turnover from the date it started business. • Kaye was incorporated on 13 April 2017 and commenced trading on the same day. • Mr Yildiz was appointed on 13 April 2017, and has been the sole director since then. • Kaye’s accounts for the year ended 31 March 2020 discloses turnover of £86,457. • Kaye’s accounts for the year ended 31 March 2020 were submitted to Companies House on 10 June 2020. • Taking into account the turnover figure shown in the accounts for the year ending 31 March 2020. Kaye would have been eligible to apply for a BBL of £21,614. • On 6 July 2020, Mr Yildiz states that a 3rd party applied for a BBL of £50,000 on behalf of Kaye, declaring that its estimated annual turnover was £210,000, though there is no evidence of a 3rd party completing the form, other than an uncorroborated cash invoice for payment. • Kaye received the BBL funds of £50,000 on 7 July 2020, which was at least £28,386 more in BBL funds than it was entitled to. • Total liabilities at liquidation amount to £44,632, of which £40,833 relates to the amount owed in respect of the BBL.
