Conduct: Prior to 25 August 2020 Daniel Graham Harvey (“Mr Harvey”) provided false information concerning the turnover of Jacob Carter Ltd (“JCL”) to obtain a BBL of £50,000 when he knew or ought to have known that JCL was only entitled to a BBL of £17,081. In that: • JCL was incorporated on 27 February 2017. • Mr Harvey was appointed as a director from incorporation. • Under the BBL scheme rules, a company that was carrying on business on 01 March 2020 was eligible for one BBL of 25% of its 2019 calendar year turnover, up to a maximum of £50,000. When making an application for a BBL, an applicant had to self-certify the company’s 2019 calendar year turnover. Where a company commenced trading after 01 January 2019, the applicant was entitled to provide a reasonable estimate of JCL’s annual turnover from the date it started business. • Due to JCL already trading on 01 January 2019, Mr Harvey was not eligible to predict Jacob’s turnover. • For the year ending 29 February 2020, the turnover has been recorded as £68,321. The accounts were signed off on 17 July 2020. Based on the accounts, JCL was entitled to a maximum BBL of £17,081 • Prior to 25 August 2020, Mr Harvey applied to the Bank for a BBL in the sum of £50,000 having stated that JCL’s turnover was £500,000. • By applying for a BBL of £50,000 JCL received £32,919 more than it was entitled to. • At liquidation, the sum of £35,968 remained outstanding in respect of the BBL.
