Conduct: On 06 May 2020 Edward Lawrence (“Mr Lawrence”) caused LMK Transport Limited (“LMK Transport”) to breach the terms of the Bounce Back Loan scheme (“BBL”) by overstating its turnover on its application for a BBL resulting in LMK Transport receiving a BBL of £50,000 when he knew or ought to have known that LMK Transport was not eligible for a loan of that amount. In that: • LMK Transport was incorporated on 23 February 2017. • A business could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of their turnover in the calendar year 2019. • Bank statements for calendar year 2019, show a turnover of £90,069. • On 06 May 2020 Mr Lawrence applied for a BBL of £50,000 on behalf of LMK Transport declaring a turnover figure of £200,000 for calendar year 2019. • On 11 May 2020, BBL funds of £50,000 were paid into the company’s bank account. • Considering the turnover figure of £90,069, the maximum BBL entitlement was £22,517. • The overstatement of turnover meant that LMK Transport received £27,483 more than it was entitled to from the BBL scheme. • On 05 October 2023, LMK Transport entered Creditors Voluntary Liquidation with known liabilities of £92,180, of which £50,395 is owed in respect of the BBL.
