Conduct: Mr Dusan Gavrilovic (‘Mr Gavrilovic’) caused Vista Barriera Limited (‘Vista’) to act in breach of the rules of the Government-backed bounce back loan (‘BBL’) scheme by declaring company turnover in the BBL application which he knew or ought to have known was overstated thereby obtaining a £50,000 BBL to which it was not entitled, in that: - The terms of the BBL scheme were such that an applicant company could obtain a loan of up to 25% of its turnover for the 2019 calendar year if it had been trading before 01 January 2019 or of its estimated annual turnover if trading began after 01 January 2019, up to a maximum value of £50,000. In either case, an applicant company was required to declare that it was carrying on its business as at 01 March 2020 and to have suffered an adverse impact caused by the Covid pandemic. The BBL scheme rules required any BBL provided to be used wholly for the benefit of the applicant company and not for any personal use. - Vista was Incorporated on 13 February 2017. - On 05 May 2020 Mr Gavrolovic applied to Vista’s bank for a BBL, declared that its 2019 calendar year turnover had been £258,000 and requested a BBL in the sum of £50,000. - According to its financial statements for the year to 28 February 2019, Vista’s turnover had been £52,799. - According to its financial statements for the year to 28 February 2020, Vista’s turnover had been £108,328. - According to the bank statements on its business current account with its bank, Vista had received trade credits of £134,349 in the 2019 calendar year. Turnover in that sum would have allowed Vista to apply for a BBL of a maximum of £33,587. - The application was approved and Vista received the £50,000 BBL monies on 07 May 2020 - As a result, Vista obtained BBL monies of £16,413 to which it was not entitled. - According to the Statement of Affairs signed by Mr Gavrilovic on 26 April 2023 Vista owed its bank £50,000 in respect of the BBL.
