Conduct: On 31 October 2020, Mohammad Ali Beikzadeh (‘Mr Beikzadeh’) caused Abek Media Ltd (‘AML’) to breach the terms and conditions of the Bounce Back Loan (‘BBL’) Scheme by overstating the turnover of AML when he knew, or ought to have known, that AML had not achieved the turnover he stated. In that: • The BBL terms and conditions stated that any business established before 01 January 2019, such as AML, was required to state its turnover for the 2019 calendar year. The amount an applicant could request was between £2,000 and £50,000 of up to a maximum of 25% of the turnover for the 2019 calendar year. • Bank statements for AML record credits to its bank account totalling £6,011 for the 2019 calendar year. Accordingly, AML was not entitled to a BBL as it had not reached the minimum turnover of £8,000 during the 2019 calendar year. • On 31 October 2020, Mr Beikzadeh submitted a BBL application for AML in which he stated that the 2019 turnover of AML was £210,000 and requested a BBL of £50,000. The funds were received on 02 November 2020. • As AML was not entitled to a BBL based on its turnover, AML received £50,000 more than it was entitled to. • The statement of affairs submitted in the liquidation process recorded that AML owed £43,887 to the BBL lender out of total creditors amounting to £43,908.
