Conduct: Aurelia Taran (“Mrs Taran”) caused Taran & Son Construction Limited (“Taran & Son”) to apply for a Government backed Bounce Back Loan (“BBL”) of £50,000 that it was not eligible for, having obtained a previous BBL for £25,000 on 6 May 2020 from a different lender. In that: A company was only allowed to apply for one BBL, for up to 25% of their annual turnover for 2019, capped at £50,000 maximum. In the BBL application form, the applicant had to declare that the company was not in the process of applying for or had already received a Bounce Back Loan. On 6 May 2020, Mrs Taran applied for a BBL of £25,000 from Bank A on behalf of Taran & Son. The BBL was received into the company bank account on 28 May 2020. On 20 May 2020, Mrs Taran applied for a second BBL of £25,000 with Bank B. The second BBL payment of £25,000 was received into the company bank account held with Bank B on 21 May 2020. A top-up BBL of £25,000 was applied for with Bank B and received on 17 November 2020. The application of the second BBL is contrary to the terms and conditions of the BBL scheme and resulted in the company receiving more than the £50,000 maximum. Taran & Son entered Creditors Voluntary Liquidation on 19 May 2023. At liquidation, Taran & Son owed £434,341.28 including £67,866.95 owing in respect of the BBLs.
