Conduct: On 16 July 2020 Ugur Yilmaz caused Niay Ltd to breach the terms of the Bounce Back Loan (“BBL”) scheme by applying for a BBL of £50,000 using overstated turnover figures, which resulted in Niay Ltd obtaining a BBL that was more than the company was entitled to. In that: - Under the BBL scheme businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of turnover. The turnover figure was self-certified by the applicant. The turnover figure required was that for the calendar year 2019 or where a business was established after 1 January 2019 it is their estimated turnover. - Niay Ltd was incorporated on 19 January 2017 - On 16 July 2020, Ugur Yilmaz applied for a BBL of £50,000 on behalf of Niay Ltd declaring that its turnover for the calendar year 2019 was £255,000. - Niay Ltd’s account for year ending 31 January 2020 show that the turnover was £84,611. - Based on the turnover figure of £84,611, the company was only entitled to a BBL of £21,152. However, Niay Ltd received an additional £28,848, that the company was not entitled to. - Niay Ltd received the BBL funds of £50,000 on 17 July 2020 - Total liabilities at liquidation amount to £64,360 of which £50,000 relates to the amount owed in respect of the BBL.
