Conduct: Adil Ashraf failed to ensure that Overton House Limited (“Overton”) complied with the Health and Social Care Act (Regulated Activities) Regulations 2014 (“HSCA”) with the result that the Care Quality Commission (“CQC”) identified 6 breaches of the HSCA and removed Overton’s CQC registration. Overton ceased to trade as a result of the removal of the CQC registration and entered liquidation owing £70,369 to creditors. 1. Overton operated a care home for vulnerable adults. 2. The CQC carried out an unannounced inspection of Overton’s premises on 03 and 04 September 2018 and found that the care home operated by Overton was inadequate and had breached the HSCA by a) failing to treat service users with dignity and respect; b) failing to seek consent to care with respect to peoples’ human rights; c) failing to ensure that service users were protected from receiving unsafe care and that the premises were safe; d) failing to ensure that the installation and operation of a CCTV system was in the best interests of service users; e) failing to have effective systems and processes in place; f) and failing to ensure suitably qualified, competent, skilled, and experienced staff were deployed to meet the needs of service users. 3. As a result of its findings the CQC cancelled Overton’s CQC registration and took steps to protect residents in alternative facilities. Adil Ashraf decided to close the care home in September 2018, and Overton entered liquidation on 13 March 2019.
