Conduct: Mr Mritunjay Kumar (“Mr Kumar”) breached the terms of the Bounce Back Loan Scheme (“BBL”) by causing MSK Infotech Limited (“MSKIL”) to overstate its turnover on its application for a BBL resulting in MSKIL receiving a BBL of £49,000 when he knew or ought to have known that MSKIL was not eligible to a BBL of any amount. In that: • Under the BBL scheme companies could borrow up to 25% of their turnover with a minimum loan of £2,000 and a maximum loan of £50,000. The turnover figure was self certified by the applicant. As the company was established before 01 January 2019, the relevant turnover for determining its eligibility for a BBL was that for the 2019 calendar year, that is its turnover for the period between 01 January and 31 December 2019. • MSKIL was incorporated on 10 January 2017 and commenced trading on incorporation; • MSKIL’s accounts for the years ending 31 January 2019 and 31 January 2020 show turnovers of £441 and nil respectively. Therefore, MSKL was not eligible to apply for a BBL of any amount. • Mr Kumar applied for a BBL of £49,000 on behalf of MSKIL declaring that MSKIL’s annual turnover for the calendar year 2019 was £198,575 and consequently on 04 February 2021 MSKIL received £49,000, that MSKL was not entitled to receive from the BBL Scheme. • Total liabilities at liquidation were £58,843 including £18,783 owed to the Bank in respect of the BBL obtained
