Conduct: Mr Divinder Singh Pahal caused DSP Smithys Hotel Ltd (DSP) to apply for Government backed Bounce Back Loans (BBL) totalling £47,000 and utilised at least £35,000 of the proceeds contrary to the terms of the BBL scheme, in providing no economic benefit to DSP with two further unexplained expended amounts totalling £8,625. In that: • When applying for a BBL, the business must confirm to the lender that the loan will only be used to provide an economic benefit to the business, for example providing working capital, and not for personal purposes. • Mr Divinder Pahal was sole director of DSP from Incorporation in December 2016 to Liquidation. • On the 7 May 2020 DSP received a BBL of £35,000 which was paid into its bank account. A further “top up” BBL of £12,000 was received on the 13 November 2020. The applications were made by Mr Divinder Pahal. • Following receipt of the first BBL of £35,000 on the 7 May 2020, £5,000 was transferred to Mr Divinder Pahal on the 11 May 2020, £500 was paid to an associated company marked “Loan DSP Smithy’s” on the 29 May 2020, there is a cash withdrawal of £500 on the 12 June 2020, £6,000 was transferred to an associated company on 1 June 2020 along with a further £6,000 on the 26 June 2020. On the 10 July 2020 a further payment of £1,500 was made to Mr Divinder Pahal and another payment of £5,000 to an associated company on 20 July 2020. There is no other income shown in DSP’s bank statement in the period 7 May 2020 to 20 July 2020. There is no other income shown in DSP’s bank statement in the period 7 May 2020 to 20 July 2020. • There are 2 unexplained payments to a third party of £3,625 on the 10 July 2020 and £5,000 on the 17 July 2020, the purpose of which has not been established. • Following the receipt of the top up BBL of £12,000 on the 13 November 2020, £6,000 was paid to an associated company on the 30 November 2022 and £2,000 to Mr Divinder Pahal with a further £3,000 to an associated company on the 4 December 2020. There is no other income shown in DSP’s bank statement in the period 13 November 2020 to 4 December 2020. • DSP entered liquidation on the 2 December 2021. Mr Divinder Pahal is listed as a creditor for £15,000 in the Statement of Affairs dated 22 November 2021. The only other creditor listed is the BBL provider for £47,491.
