Conduct: On 10 July 2020, Mr Eray Ali (“Mr Ali”) caused Bella Nova Café Ltd (“Bella Nova”) to breach the terms and conditions of the Bounce Back Loan (“BBL”) scheme by overstating its turnover on the BBL application when he knew or ought to have known that the turnover claimed was incorrect. As a result, Bella Nova received more funds than it was entitled to from the BBL scheme. In that:    • Under the BBL scheme businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of turnover. The turnover figure was self-certified by the applicant. The turnover figure required was that for the calendar year 2019 or where a business was established after 01 January 2019 it was their estimated annual turnover from the date the business started trading. • Bella Nova was incorporated on 13 December 2016 and commenced to trade prior to 01 January 2019. It was therefore not entitled to provide an estimate of annual turnover.   • On 10 July 2020, Mr Ali applied for a BBL of £50,000 on behalf of Bella Nova. The application asked Mr Ali to declare turnover for the calendar year 2019. Mr Ali declared turnover for Bella Nova was £210,000. Bella Nova received the BBL funds of £50,000 on 14 July 2020. • Bella Nova’s filed accounts for the periods ending 31 December 2019 and 31 December 2020 showed turnover of £61,882 and £98,290 respectively. • Bella Nova’s bank statements show sales related credits of £63,150 for the 2019 calendar year. Based on this amount Bella Nova would have been entitled to apply for a BBL of £15,788. Therefore, Bella Nova has received BBL funds of £34,212 that it was not entitled to. On 02 August 2024 Bella Nova entered Creditor’s Voluntary Liquidation with total liabilities of £75,587, of which £48,838 was owed in respect of the BBL and interest and charges.
