Conduct: Between 01 October 2020 and liquidation on 23 October 2023, Mr Lee Michael Deegan (“Mr Deegan”) caused Simply Beautiful Concepts Ltd (“SBC”) to trade to the detriment of HM Revenue and Customs (“HMRC”) in respect of Value Added Tax (“VAT”) and Corporation Tax (CT), in that: VAT • As of 07 December 2021, SBC owed £29,499.37 to HMRC in respect of historic VAT debt. • SBC submitted VAT returns for 5 periods from the quarters ending November 2021 to November 2022, which declared a total of £55,353.97 owed to HMRC in respect of VAT. • HMRC raised assessments amounting to a further £32,687.94 for the VAT quarters ending February 2023 to August 2023. • Between 07 December 2021 and liquidation, three payments totalling £13,150.70 were made and allocated to VAT returns for quarters prior to November 2021. • HMRC raised interest surcharges totalling £17,327.78 and penalties of £857.66. Corporation Tax • SBC submitted CT returns, totalling £43,639.58, for the periods ending 31 January 2019, 31 January 2020 and 31 January 2021 which all became due for payment on 1st October of the following year. • No payment was made towards the above CT liability. • HMRC raised interest charges amounting to £4,095.22. Comparative treatment • Between 01 October 2020 and 20 October 2023, bank statements record that: - SBC received £3,568,183.92 into its bank account, minus any credits from transactions returned as unpaid. - SBC remitted £3,590,386.35 out of its bank account, minus any debits that were subsequently returned as unpaid. - Mr Deegan received a net amount of £188,189 from SBC’s bank account. - Trade creditors received £2,934,823.13 from SBC’s bank account. - Between 1 October 2020 and liquidation, no payments were made to HMRC in respect of CT. - Between 07 December 2021 and liquidation, £13,150.70 was paid to HMRC in respect of VAT, which was allocated against the outstanding historic VAT debt.
