Conduct: 1. On 25 June 2020, Mr Mohammed Jahangir Alam (“Mr Alam”) caused Spice Fusion Restaurant New Mill Ltd (“Spice“) (“the Company”) to provide false or misleading information regarding turnover when applying for a Government backed Bounce Back Loan (“BBL”) totalling £50,000, contrary to the terms of the BBL scheme. In that: The BBL scheme permitted for a business established before 01 January 2019 a loan of up to 25% of a business’ turnover in the calendar year 2019, or estimated turnover if the business had been established after 01 January 2019. Spice was incorporated on 2 December 2016. On 25 June 2020, Mr Alam made an application for a BBL of £50,000 stating the company had a turnover of £202,000. However Spice’s Profit and Loss Account stated that turnover for the year ended 31 December 2019 was £72,803 and as a result Spice was eligible for a BBL of approximately £18,200. Spice received the BBL totalling £50,000 into its bank account on 26 June 2020, which was approximately £31,800 more BBL funding than it was entitled to. One repayment of £936.07 was made in respect of the BBL, with the BBL provider being the major creditor at liquidation. 2. Between 31 December 2019 (the date of the last set of filed accounts) and 06 August 2021 (the date of the Liquidation), Mr Alam failed to ensure that Spice Fusion Restaurant New Mill Ltd maintained and/or preserved adequate accounting records or in the alternative he failed to deliver up such records in the liquidation. As a result of the failure to maintain, preserve and/or deliver up adequate accounting records, it has not been possible to determine the following: Whether income amounting to £157,529.24 received into the company bank account after the last prepared accounts constituted the total income of the company. Whether payments of £157,202 made from the company’s bank account after the last prepared accounts related to bona fide business expenses. Whether the BBL funds obtained were utilised for the economic benefit of Spice as required by the terms and conditions of the BBL scheme The purpose of cash withdrawals from Spice’s bank account totalling £71,860 between 6 July 2020 and 14 June 2021. Mr Alam states that these payments were made in respect of repairs, purchases, wages, rent, accountant and the insolvency practitioner but has not provided any documentary evidence in support.
