Conduct: On 21 July 2020 Ionel Florin Stoica (“Mr Stoica”) breached the terms of the Government backed Bounce Back Loan (“BBL”) Scheme by causing IMD Services Ltd (“IMD”) to overstate its turnover on its application for a BBL, resulting in the company receiving a BBL of £50,000 when he knew, or ought to have known, that IMD was not entitled for a loan of that value, in that: • The BBL scheme terms allowed businesses to receive a loan of up to 25% of their annual turnover for the 2019 calendar year, which the applicant would self-certify when completing the BBL application. Businesses could receive a BBL of between £2,000 and £50,000. • If a company was established after 01 January 2019, they were allowed to estimate the company turnover from the date the company started. The terms of the BBL scheme stated that the BBL was to be used only for the economic benefit of the business it was being claimed for, used wholly for business purposes and not personal purposes. • IMD was incorporated on 25 November 2016, so was required to use actual turnover for the 2019 calendar year on the BBL application. • On 21 July 2020 Mr Stoica declared on the IMD’s BBL application form an annual turnover of £210,000, and consequently on 26 July 2020 IMD received a BBL of £50,000. • IMD’s bank statements for 2019 show trading credit of £39,161. • Based on the bank credits for 2019, IMD would have been entitled to apply for a BBL of £9,791 and received £40,209 more than it was entitled to from the BBL scheme. • IMD made BBL repayments of 16,068.82. • IMD entered a Creditors Voluntary Liquidation on 26 March 2025. • At Liquidation, IMD had liabilities totalling £60,704 of which £35,967 was owed to the Bank in respect of the BBL.
