Conduct: From 01 June 2017, Xiaolu Zheng (“Mr Zheng”) failed to ensure that Yummy 888 Ltd complied with its statutory duty to register for Value Added Tax (“VAT”), file VAT returns and file accurate Corporation Tax (“CT”) returns, in that: • Yummy filed CT returns for the year ending 31 November 2017 and 31 November 2018 declaring Yummy’s turnover as £67,182 and £75,536 respectively • Following a HM Revenues and Customs (“HMRC”) investigation it was discovered that Yummy had failed to disclose income generated through a food delivery service. • He had authorised the food delivery service to send monies due to Yummy to his personal bank account • Following an HMRC inspection it was discovered Yummy had reached the VAT threshold in April 2017 and the effective date for VAT registration should have been 01 June 2017. • HMRC calculated total sales for the period 01/06/2017 to 29/02/2020 to be £1,247,071 and VAT due of at least £207,845 • HMRC deemed the behaviour to be deliberate and on 24 August 2021 HMRC raised a penalty assessment for £53,000.52
