Conduct: Mr Jonathan Mathew Hacker (“Mr Hacker”) caused Hacker Investments Limited (the company) to obtain a Bounce Back Loan in the sum of £50,000 when he knew, or ought to have known, that the company was not entitled to that amount under the terms of the BBL Scheme. As a result, the company obtained funds in excess of its legitimate entitlement, in that: • Under the BBL Scheme, a business could apply for a loan between £2,000 and £50,000, capped at 25% of its annual turnover for the calendar year 2019. Where a business was established after 1 January 2019, applicants were instructed to apply the 25% limit to their estimated annual turnover from the date the business commenced trading. • Hacker Investments Limited was incorporated on 11 November 2016. Accordingly, the company was required to base its BBL application on its actual turnover for the 2019 calendar year. • The company’s financial year runs from 30 November 2018 to 29 November 2019. The Company’s Accounts (P&L Accounts) from that period show turnover figure of £47,819. • On 18 June 2020, Mr Hacker signed a Bounce Bank loan agreement on behalf of Hacker Investments Limited, for an estimated annual turnover of £250,000. Hacker Investments limited subsequently received £50,000 in BBL funds despite only being entitled to £11,955. • Repayments totalling £6,801 have been made towards the BBL. • On 06 March 25, Hacker Investments Limited entered liquidation with total liabilities of £47,785, of which £ 43,199 related to the outstanding BBL.
