Conduct: On 08 May 2020 Mr Geoffrey Adam Thompson (“Mr Thompson”) breached the terms of the Bounce Back Loan (“BBL”) scheme by causing Stessa Leisure Holdings Limited (“SLHL”) to apply for a BBL of £50,000 when he knew or ought to have known that SLHL was not eligible for the scheme because another company within the same group had already received a BBL, in that: • When applying for a BBL companies had to sign a declaration confirming that they were not part of a wider group of companies that had already received a BBL. • On 08 May 2020 Mr Thompson applied for a BBL of £50,000 on behalf of SLHL. Declaring “I/We confirm that this is my/our only application for a Bounce Back Loan for this business, and I am/we are not part of a wider group which has already received a Bounce Back Loan” Mr Thompson signed this declaration at a time when one other company in the group structure had received a BBL of £50,000. • On 12 May 2020 SLHL received a BBL of £50,000 • Mr Thompson knew or ought to have known that SLHL was not eligible to a BBL. As a result, SLHL received £50,000 more than it was entitled to from the BBL scheme. • SLHL entered Creditors Voluntary Liquidation on 04 April 2024. • At liquidation, SLHL had liabilities totalling £50,750, of which £49,664.13 was owed to the bank in respect of the BBL.
