Conduct: Ali Ahmeti (“Mr Ahmeti”) caused London Road Hand Car Wash Ltd (“LRHC”) to apply for and obtain a government backed bounce back loan (“BBL”) of £50,000, which was more than the amount to which it was entitled, in that: The BBL scheme enabled a business to obtain a BBL of up to 25% of its turnover for the calendar year 2019, up to a maximum amount of £50,000. Where a business was established after 1 January 2019, the applicant could apply the 25% limit to their estimated annual turnover from the date they started their business. LRHC was incorporated on 28 October 2016, and was trading prior to 1 January 2019, so was not eligible to use an estimated turnover figure on its BBL application. Mr Ahmeti applied for a £50,000 BBL on behalf of LRHC on 24 May 2020, entering an annual turnover figure of £200,000 on the application form. LRHC received the £50,000 BBL on 2 June 2020. LRHC’s accounts for the year ending 31 October 2019 record turnover of £83,465, and its accounts for the year to 31 October 2020 record turnover of £35,294. LRHC’s bank statements record turnover of £61,561 in the 2019 calendar year, which would have entitled the company to a BBL of £15,390. Therefore, LRHC received a BBL of £34,610 more than it was entitled to. When LRHC entered liquidation on 4 October 2022, it declared liabilities totalling £79,532. The BBL provider has claimed £50,341.37 in the liquidation.
