Conduct: On 9 June 2020, Bogdan-Gabriel Lazar (“Mr Lazar”) caused Eugens Builders Limited (“Eugens”) to obtain a government-backed Bounce Back Loan (“BBL”) of £50,000 using overstated turnover figures, when he knew, or ought to have known, that Eugens was only eligible for a loan to a maximum amount of £12,489, in that: • Under the BBL scheme a business was able to borrow up to 25% of its turnover in calendar year 2019, up to a maximum of £50,000 and, if the business was established after 1 January 2019, it was to apply the 25% limit to its estimated annual turnover from the date it started. The turnover figure was self-certified by the applicant. • Eugens was incorporated on 11 September 2016 and commenced trading on the same day. • Mr Lazar was appointed as sole director on 11 September 2016 and remained so until Liquidation. • On 9 June 2020, Mr Lazar applied for a BBL of £50,000 on behalf of Eugens, stating in the loan application that Eugens’ relevant turnover was £222,073. • Company accounts for the years ended 30 September 2019 and 30 September 2020 declared turnover of £22,072 and £49,956 respectively, therefore based on the higher of these figures, Eugens was entitled to a BBL of £12,489. • On 10 June 2020, funds of £50,000 were credited to Eugens’ bank account. • Eugens therefore received BBL funds of at least £37,511 more that it was entitled to. • Eugens made BBL repayments of £6,804.27 • At the date of the Creditors’ Voluntary liquidation on 19 November 2024, the total liabilities amounted to £57,726.41, of which £44,898 was in respect of the BBL.
