Conduct: On 6 May 2020 Mr Timothy Carr (“Mr Carr”) caused Carbon Recruitment Group Ltd (“Carbon Recruitment”) to apply for a government backed Bounce Back Loan (“BBL”) of £30,000 that it was not eligible for, having obtained a previous BBL for £25,000 on 05 May 2020 from a different lender. Mr Carr knew or ought to have known that Carbon Recruitment was not entitled to the second BBL in that, • Under the BBL scheme, businesses could apply for a single loan of up to 25% of turnover, capped at £50,000. While top ups were permitted, the total borrowing could not exceed 25% of turnover and only one BBL facility was allowed per business. • On 4 May 2020, Mr Carr applied to Bank A for a £25,000 BBL on behalf of Carbon Recruitment; the funds were received on 5 May 2020. • On 6 May 2020, he submitted a further application to Bank B for £30,000; the funds were received on 14 May 2020. • The Bank B terms required a declaration that no other BBL application had been made. Mr Carr falsely declared that Carbon Recruitment had not applied elsewhere. • Mr Carr knew, or ought to have known, that Carbon Recruitment was not entitled to the second BBL at the time of application and receipt of funds. • Carbon Recruitment entered creditors’ voluntary liquidation on 7 March 2025. • The company’s deficiency at Liquidation was £276,044.14 of which £5,316.44 is owed to Bank A and £18,995.74 is owed to Bank B.
