Conduct: Ben Justin Wild (“Mr Wild”) failed to ensure that Wild View Events Limited (“Wild”), complied with its statutory obligations to HM Revenue and Customs (“HMRC”) to make payments when due from 7 December 2016 when the VAT for period ending 10/16 became due, and caused Wild to trade to the detriment of HMRC in respect of VAT and PAYE/NIC from at latest 6 April 2018 to 25 February 2020 (the date of liquidation), resulting in a claim from HMRC of £212,080 at liquidation. • Wild lodged VAT Returns for the periods from 10/16 to 10/19 totalling £157,868 inclusive of surcharges. An assessment of £4,398, inclusive of surcharges, was also levied by HMRC in respect of the period ending 01/20. VAT was overdue and in arrears from period ending 10/16 onwards. • From 7 December 2016 Wild paid VAT totalling £35,079, which when applied to the earliest VAT debt leaves VAT remaining overdue from period ending 01/17 onwards. • HMRC have claimed at least £127,187 in respect of VAT still due for the period from 01/17 to 01/20. • Wild lodged PAYE/NIC/Student debt Returns for the period from April 2017 to February 2020 totalling £125,541 being £40,702 for 17/18, £37,886 for 18/19 and £46,953 for the period to February 2020. While payments totalling £37,670 were made towards these liabilities, they were insufficient to discharge the debt in full for each of the tax years in respect of PAYE/NIC for all years 17/18 to 19/20 and HMRC have claimed £84,838 in respect of PAYE/NIC for all years 17/18 to 19/20 plus interest. Detrimental Treatment of HMRC • Between 6 April 2018 and 31 March 2020 (date of last available entry); £1,046,739 was paid into the Wild’s bank account of which £25,579 was identified as being paid to HMRC and £1,021,160 to third parties or trade and expense creditors. • Wild’s Statement of Affairs showed total outstanding liabilities of £247,936 including a sum of £205,882 which was due to HMRC. • HMRC have claimed £213,118 within the liquidation proceedings being VAT of £128,129 and PAYE of £84,838 plus interest.
